1Purpose and acceptance
These Terms and Conditions (the "Terms") govern access to and use of the website and services of Terraes Ciudadano ("Terraes", "the Platform", "we"). By accessing, browsing or using the Platform, the user ("you", "the User") declares that they have read, understand and accept these Terms in full. If you do not agree, you must refrain from using the Platform.
Acceptance is deemed granted by the mere use of the service and, where applicable, through the express ticking of the acceptance boxes, in accordance with Ley 527 de 1999 on electronic commerce and data messages.
2Definitions
For the purposes of these Terms, and in accordance with Article 3 of Ley 1581 de 2012:
- Personal data: any information linked to or that can be associated with a specific or identifiable natural person.
- Data subject: the natural person whose personal data is subject to processing (you).
- Data controller: Terraes, which decides on the database and/or the processing of the data.
- Processing: any operation on personal data: collection, storage, use, circulation or deletion.
- Authorization: the data subject's prior, express and informed consent for the processing.
- Privacy notice: a communication that informs the data subject about the processing policies and how to access them.
- Referential appraisal: an automated valuation (AVM) of an informational nature, which does not constitute an official commercial appraisal.
3Description of the service
Terraes Ciudadano is an information platform that offers, free of charge, a map of housing prices by area, value estimates per property with their confidence range, and tools for citizens to consult and understand property information based on public and market data.
The Platform is a guidance tool. It is not a public entity, it does not provide cadastral, notarial or registry services, and it does not replace procedures before IGAC, cadastral operators, the Superintendency of Notaries and Registry or the tax authorities.
4The appraisal is referential — it is not official
Terraes value estimates are referential and informational. They are generated with automated models (AVM) on public and market data, and include an uncertainty range. They do not constitute a commercial appraisal within the terms of Decreto 1420 de 1998 or of IGAC regulations, they are not performed by an appraiser registered in the Open Registry of Appraisers (RAA, Ley 1673 de 2013), and they must not be used as the sole basis for purchase, sale, credit, collateral, taxation or litigation decisions. For an appraisal with legal effects, consult an appraiser or competent entity.
5Permitted and prohibited use
You may use the Platform to consult information for personal, informational and good-faith purposes. You undertake not:
- To extract data in bulk or in an automated manner (scraping, bots) without written authorization.
- To impersonate another person or provide false data, especially when signing the citizen initiative.
- To use the Platform for unlawful, fraudulent purposes or those that infringe the rights of third parties.
- To interfere with the security, integrity or availability of the service.
- To reproduce, resell or commercially exploit the content without authorization.
Non-compliance may lead to suspension of access, without prejudice to the corresponding legal actions.
6Citizen initiative and right of petition
The "citizen signature" is a voluntary expression of support to request that the municipal administration and its cadastral operator adopt modern cadastre tools. It is not an official procedure that you initiate nor does it create any obligation for you.
So that this support is verifiable and carries institutional weight, we collect your name, ID number and email. Based on the signatures gathered, Terraes may consolidate and file before the competent authority a right of petition in the general interest (art. 23 de la Constitución Política; Ley 1755 de 2015), the outcome of which we will inform you by email. The authority has the legal response deadlines (as a general rule, fifteen (15) business days).
Your ID number is used solely to verify that there is a real person behind each signature and is never published nor shared for commercial purposes.
7Personal data processing
Controller: Terraes, domiciled in Colombia, with the support channel privacidad@terraes.com. This policy is issued in accordance with Ley 1581 de 2012, the Decreto 1377 de 2013 and the Decreto 1074 de 2015.
Data we collect
- Identification and contact: name, ID number and email address (when signing the initiative or creating an account).
- Usage: searches performed, properties of interest and an anonymous device identifier, without associating it with your identity.
- Technical: browser data necessary to operate and protect the service.
Purposes
- To record and verify your signature in support of the citizen initiative.
- To consolidate and file, where applicable, the right of petition before the competent authority.
- To inform you by email of the status and outcome of the request.
- To operate, maintain and improve the Platform and its estimates.
- To handle your requests for information, complaints and claims (PQRS).
Authorization
Processing requires your prior, express and informed authorization, which you grant by ticking the corresponding box. The authorization is revocable at any time. We do not collect sensitive data or data of minors for this initiative.
Security, transfers and validity
We adopt reasonable technical and administrative measures to protect your data. We may rely on data processors (e.g. infrastructure providers) under duties of confidentiality. We retain your data for as long as the purpose that justified its collection lasts and the applicable legal deadlines; once these are met, it is deleted or anonymized.
8Your rights as a data subject
In accordance with Article 8 of Ley 1581 de 2012, as a data subject you have the right to:
- Know, update and rectify your data.
- Request proof of the authorization granted.
- Be informed about how your data is used.
- Revoke the authorization and/or request the deletion of the data when there is no legal duty to retain it.
- File complaints before the Superintendency of Industry and Commerce (SIC).
To exercise them, write to us at privacidad@terraes.com. The queries are handled within a maximum of ten (10) business days and the claims within a maximum of fifteen (15) business days, extendable in accordance with the law. You may also request the deletion of your signature at any time.
9Intellectual property
The Terraes brand, the software, the design, the texts and the aggregated estimates are owned by Terraes or its licensors and are protected by intellectual property regulations. Information from public sources retains the nature and attribution of its original source. No license other than the personal use described herein is granted.
10Availability and limitation of liability
The Platform is offered "as is" and "as available". We make reasonable efforts to keep the information up to date and the service available, but we do not guarantee accuracy, continuity or the absence of errors. To the extent permitted by law, Terraes shall not be liable for decisions made on the basis of referential estimates, nor for indirect damages arising from the use or impossibility of use of the service. Nothing in these Terms limits the non-waivable consumer rights recognized by Ley 1480 de 2011.
11PQRS and contact
For petitions, complaints, claims or requests regarding your data, write to us at privacidad@terraes.com. We will handle your request within the legal deadlines and indicate the follow-up channel.
12Applicable law, amendments and validity
These Terms are governed by the laws of the Republic of Colombia and any dispute shall be submitted to the jurisdiction of Colombian courts. We may amend these Terms and the Data Policy; relevant changes will be announced on the Platform and will take effect from their publication. The current version is the one published on this page, last updated 6 de junio de 2026.
